Two Persons In Court Over Alleged Assault

Osun state police command has arraigned two suspects, Ajayi Jimoh 43 and Adewumi Tola, 38 over alleged assault on police men.

The accused are facing ten count charges bothering on assault,malicious damage and an attempt to kill.

The charge sheet read in court revealed that the accused conspired among themselves to commit felony by slapping one Olakunle Muhammad.

The accused persons were charged for tearing the police uniform and maliciously damaged recommended glass  worth N10,000 property of Superintendent of Police Adebiyi Femi and deputy superintendent of police Abioye Sanjo respectively who were on special assignment to forestall any break down of law and order at the court.

It added that the Suspects threatened to kill one Olakunle Muhammed.

The charge sheet disclosed that the suspects thereby committed  an offence contrary  to sections 516 (a), 356 (4), 451, 351, 84, 509, 126 and punishable under section 86 (1) of criminal code cap 34 Vol.II laws of Osun state Nigeria 2003.

According to the charge sheet,the suspects committed the offence on October 10, 2018 at about 11:30am at Magistrate court 3 Oke fia area Osogbo.

However, the suspects pleaded not guilty to the ten count charges preferred against them.

The defence counsel, Mr Kazeem Badmus and Mr O A Adebiyi prayed the court to grant the suspects bail

They added that the accused did not committed any offence related to what is in the charge sheet, adding that the two suspects did not know each other from anywhere.

The prosecutor Inspector Oladoye Joshua objected the defence counsel, saying the case is a serious offence that court should not take it lightly.

The defence counsel urged the court to dismissed the objection of the prosecutor.

The Presiding Magistrate A O Ajanaku overruled the objection of the prosecutor. She said that the court is not allowed to used bail as point of punishment and the prosecutor should provide legal evidence of damage recommend.

She granted the accused bail with the sum of N200,000 and one surety.

She added that the sureties must be civil servants and swear to an affidavit of means, produce three years tax clearance certificate.

The case was adjourned to December 19 2018.
