Osun LG Election: Court Hears PDP Petitions September 13

The Federal High Court sitting in Osogbo has set September 13, 2022, for the hearing of the suit filed by the Osun State Chapter of the PDP to challenge the conduct of local government councils election in Osun State by the State’s electoral body, OSSIEC.

OSUN DEFENDER reports that PDP in the suit is seeking the interpretation of some sections of the Electoral Act, 2022, upon the determination of which it is seeking to restrain the OSIEC perpetually from going ahead with any local government council election unless and until there has been full compliance with the provisions of the Electoral Act, 2022, in the conduct of the planned election.

The Peoples Democratic Party (PDP) had kicked against the conduct of local governments election in the state slated for October 15, 2022, and approached the court to determine the legality and constitutionality or otherwise of the process.

The PDP had argued that going ahead with the election will violate sections of the Electoral Act 2022, and other provisions of the law and wants the court to make pronouncement that will stop the illegality.

In the suit before the court, the PDP is asking the court for an injunction to stop the conduct of the election by OSIEC, which it maintained was not in line with the law. The PDP is also praying the court to restrain INEC from being part of the illegality and criminality being perpetrated by OSIEC as the whole exercise will amount to a nullity at the end of the day.

In another development, the Action Peoples Party (APP) on Friday filed a suit before the Federal High Court in Osogbo to stop the OSSIEC from going ahead with local governments election in Osun state.

The APP said it would not support illegality under whatever guise and urged the court to uphold the various provision of the laws, which OSSIEC is obviously not taking into consideration in its decision to conduct the local governments election.
