The Federal High Court of Nigeria has declared Hon. Sadiq Ismail Kayode, the candidate of Action Democratic Party (ADP), as a properly nominated candidate for the election into the Orolu State Constituency of the Osun State House of Assembly.
In a judgement handed down on January 26th, 2023, the court granted all the reliefs and prayers sought by the plaintiffs, including a mandatory order directing the electoral body to remove the candidacy of Hon. Sadiq Ismail Kayode from Boripe/Boluwaduro State Constituency of Osun State to Orolu State Constituency of Osun State.
The court also ordered the electoral body to apply the provisions of Section 39(1) & (2) of the Electoral Act 2022 to the Orolu State Constituency of Osun State House of Assembly as the 27th State Constituency of Osun State House of Assembly, where Hon. Sadiq Ismail Kayode is the sole candidate in an uncontested election.
Furthermore, the court ordered the electoral body to declare Hon. Sadiq Ismail Kayode as the winner of the Orolu State Constituency of Osun State House of Assembly under Section 39(1) of the Electoral Act 2022 and issue a duly completed Declaration of Result Form as may be prescribed by the defendant.
All the processes filed by the defendants were struck out for incompetence, having been filed without compliance with the Electoral Act and the Rules of Court
