Melaye’s Recall: We’ll Proceed In Accordance With Appeal Court Judgement – INEC

The Independent National Electoral Commission says it will proceed with the process for the recall of Senator Dino Melaye in line with the judgement of the Court of Appeal.

INEC’s Director of Publicity and Voter Education, Mr Oluwole Osaze-Uzzi, said this in a telephone interview on Channels Television’s Politics Today.

“For now, all legal hurdles as far as we are aware have been removed so the commission should proceed as if the case did not occur.”

A trio of Judges, led by Justice Tunde Awotoye, of the appellate court on Friday dismissed the appeal filed by Melaye against the judgment delivered by Justice Nnamdi Dimgba at the Federal High Court in 2017, on grounds that there was no cause of action.

Justice Dimgba had on September 11, 2017, dismissed the suit filed by Senator Melaye, seeking to stop INEC from initiating his recall from the National Assembly.

He held that senator Melaye’s complaints were ‘hasty, premature and presumptuous” and therefore ordered INEC to go ahead with its planned verification exercise of the 188,588 registered voters who were said to have signed a petition in support of the recall process.

Unsatisfied with Justice Dimgba’s judgement, Malaye proceeded to the Appeal Court two days later, arguing that the Federal High Court judge “erred in law” when he validated the petition presented to INEC for his recall.

But the Appeal Court in dismissing the suit on Friday held that the Federal High Court ought not to have entertained Melaye’s suit ab initio.

Asked about the specific steps INEC would take in continuing the process based on the judgement, Mr Osaze-Uzzi said the commission would get in touch with Senator Melaye and ask him to give it an agent after which it would conduct a verification exercise for the signatories to the recall petition.

The electoral body will also release a timetable informing Nigerians of every step in the process and the date for each.

“If all the steps are successful, then we will have to go and conduct a referendum,” he said.

Senator Melaye has, however, rejected the ruling of the Appeal Court, and will appeal it at the Supreme Court.

After the judgement, he told Channels TV, “Though I walk through the valley of the shadow of death, I fear no evil. The battle to continue to speak the truth and fight for the oppressed civil servants and people of Kogi State is a battle of no retreat, no surrender. Every lie has an expiry date. I shall overcome.”

Dino Melaye Urges Senate To Revisit Peace Corp Bill

President Muhammadu Buhari has been urged to review his position in withholding assent on the bill to establish Peace Corps of Nigeria.

Senator Dino Melaye who raised the adoption of a Point of Order during plenary urged the senate to revisit the bill with a view to veto the president if he failed to rescind his rejection of the bill.

Recall that President Buhari had cited duplication of duty and funding challenges in declining assent to the Nigerian Peace Corps (Establishment) Bill, 2017 recently passed by the National Assembly.

Melaye however said that the bill should be given priority by Buhari. He said, “

The same thing happened when the Nigeria Security and Civil Defence Corps (NSCDC) was to be established; there was also the same complaint that there was no money and all of that.

“But today we can see the advantages of the civil defence and how they have helped in safeguarding the government infrastructure.

“About 5.5 billion dollars was borrowed from euro bond; what part of it will the youths of this country benefit from?

“About one billion dollars is to be spent on security and how does this affect the youth of this country?

“Without fear or favour, the Peoples Democratic Party (PDP), in 16 years, borrowed N6 trillion and this government in three years, has borrowed N11 trillion but there is no specific programme that will empower the youth.

UPDATE: Court Grants Melaye N100,000 Bail In Alleged Assassination Alarm Suit

The Federal Government on Thursday arraigned the Kogi West Senator Dino Melaye before the High Court of the Federal Capital Territory in Abuja on two counts of giving false information about an assassination attempt on his life to the Police in April 2017.

Melaye was accused of falsely incriminating the Chief of Staff to Governor Yahaya Bello of Kogi State, Mr. Edward Onoja David, in the said assassination attempt.

The offences were said to be punishable under sections 140 and 393 of the Peal Code Law, Cap. 89, Laws of Northern Nigeria, 1963.

Shortly after his plea, his lawyer, Mr. Rickey Tarfa (SAN), moved his bail application filed on February 22, 2018.

The bail application was opposed by the prosecuting counsel, Mr. Shuaibu Labaran.

But in her bench ruling, the judge, Justice Olasunbo Goodluck, granted bail to the defendant after dismissing the prosecution’s opposition which she ruled was “based on inadmissible affidavit evidence.”

The judge granted bail to the defendant in the sum of N100,000, with one surety.

The judge ruled that the surety to be provided by the senator must be a federal civil servant of at least Grade Level 14 in any federal parastatal or establishment.

The surety must also provide proof to be a resident of the Federal Capital Territory.

Melaye was accompanied to the Thursday’s proceedings by about 11 senators, including Senators Ben Murray-Bruce and Shehu Sani.

Nigerians Don’t Take Controversial Waku Serious – Kogi Gov’s Aide

Kogi State Governor, Alhaji Yahaya Bello, has hit back at Sen. Joseph Waku over claims by the ACF Chieftain that Governor Yahaya Bello had a hand in the alleged assassination attempt on Sen. Dino Melaye, saying Waku has not surprised Nigerians who “see him as a clownish alarmist.”
Speaking through his Director General on Media on and Publicity, Kingsley Fanwo, in Lokoja over the weekend, the Governor said he won’t succumb to efforts at distracting his administration from the ” noble New Direction Agenda aimed at repositioning the state and recovering it from the ruins of the past.”
“Waku should not see Kogi as his fishing point in his efforts at being heard after decades of obliviousness and irrelevance. He should not misrepresent the highly respected Arewa Consultative Forum, an organization that is committed to the development and unity of the Northern Region of Nigeria.
“His assertion that the North will hold the Governor responsible if anything happens to Dino is reckless, unsubstantiated, uncharitable and indefensible. Waku should apologize to the people of Kogi State for his wanton allegations and also to the Arewa Consultative Forum for allowing his uninformed position embarrass the noble organization.
“Sen. Dino Melaye’s alleged attack is currently being investigated by the Police. Waku should explain to Nigerians the reasons behind his  desperation to pin the Governor to the allegation. By this act, Waku has shown how low he has gone over the years in his business of courting unnecessary controversies.
“Senator Dino Melaye knows the implications of alleging that Governor Yahaya Bello was behind the attacks in him. He won’t toe that line because that will be too hot for him to handle. Governor Yahaya Bello has made criminality difficult in Kogi State. He abhors criminality and would not condone any act of brigandage either against Dino Melaye or by Dino Melaye as the Chief Security Officer of the State.
“We are not ignorant of Senator Dino’s plans to make a whirlwind spring out of tea cup and we are too focused to join issues with him. Nobody will be allowed to disturb the peace of Kogi State. His efforts to make Kogi ungovernable will fail because the people of Kogi State are behind the Governor.
“But if Dino actually said that, he will have to prove that. It is an insult on the sensibilities of Kogites to play politics with the rot in the civil service. The present administration in the state will ensure a holistic reform in the civil service. Without the reforms, Kogi will be suffocated to death. Governor Yahaya Bello had nothing against Dino. If Dino has issues with him, he should speak up because the Governor is a peace loving person.
“Governor Yahaya Bello is not known for controversies or blackmail. He is prepared to work with people who have the interest of the state at heart. He will never subscribe to blackmail by people who see Kogi as a big elephant that must be shared. We are undaunted by the ongoing comedy but we shall never compromise the security of Kogites.
“Those who think the Governor could be intimidated to submission should have a rethink. He is focused on the task of serving the people of Kogi State. The people know their real proponents who are selfless and modest. We shall make our position known after the  Police investigation of the incident. I reiterate that Kogites know the truth about the matter.
“Sen. Dino Melaye is not the only Senator in Kogi State. But while others are empowering their people and complimenting the efforts of the State Government, Melaye was stirring controversies both at the National Assembly and in the state. His call to insurrection cannot see the light of the day. If he wants to speak for the voiceless, he should have sold one of his multimillion fleet of cars to provide food for them first. You can’t swim in an inexplicable wealth and still claim to be speaking for the masses. I am sure if the Governor had agreed to share the ‘elephant’, all these drama wouldn’t have ensued.
“The Government of Kogi State is not interested in any mud fight and will therefore not join issues with professional blackmailers. This government was the first to publish its bailout funds and the accounts where the balances were kept. Transparency and accountability are the hallmarks of our government. We are with the people and the people are with us.”
Fanwo urged Kogites to remain solidly behind the Governor as the current war is as a result of the Governor’s refusal to share the Commonwealth of the people with those who think they could constitute themselves into a cabal for corruption and diversion of development funds.
“They are not fighting for the people but their bellies. They want the Governor to share the money he is currently using to build roads, hospitals and schools to them. But the Governor insisted he will use Kogi resources for Kogi people. The people of Kogi know these facts. They can’t be fooled”, he said.
