Against the backdrop of the 82 amended consolidated grounds of appeal filed by Governor Oserheimen Osunbor of Edo State against the judgment of the Election Petitions Tribunal which nullified his election, Comrade Adam Oshiomhole, the Action Congress (AC) governorship candidate has filed an amended briefs against the appeal.
Justice Peter Umeadi-led Election Petitions Tribunal had nullified Osunbor election and declared Oshiomhole the validly elected governor of the state during the April 14, 2007 governorship election in the state.
Osunbor has subsequently approached the Appeal Court sitting in Benin City, the state capital to set aside the judgment of the tribunal.
The Court of Appeal sitting in the state capital commenced hearing of the appeals on September 25, 2008.
It would be recalled that on the commencement of hearing, the appellate court granted the appellants application to file and argue two additional grounds of appeal, sequel to the application filed by Osunbor’s counsel, Chief Efe Akpofure (SAN).
Beside, the appellate court also granted the appellants leave to amend their briefs and to consolidate their interlocutory appeals with the substantive appeal already before the court.
The court also granted the respondents in the appeal, leave to file their consequential brief of arguments within eight days effective from September 25.
