INdications have shown that the new Election Petitions Tribunal that will re-try the petition of the Action Congress (AC) governorship candidate in Osun State, Engineer Rauf Aregbesola against the election of the embattled Governor Olagunsoye Oyinlola may arrive in the state this week.

OSUN DEFENDER gathered that though, as at Friday, the President, Court of Appeal, Justice Umar Abdullahi was yet to receive a copy of the judgment, it is expected that the same is expected to be received latest on Monday.

After the Court of Appeal president might have received a Certified True Copy of the judgment on Monday and peruse same, the new tribunal members would be mandated immediately to proceed on the re-trial of the petition, a source at the Court of Appeal said.

The source, who spoke in confidence, further stated that the relevant unit of the appellate court has been put on standby by Abdullahi to isolate issues on the judgment.

It was further learnt that the unit has commenced work on the compilation of list of competent and reliable judges, who could dispense justice to all the parties in the matter.

According to the source; “Although Justice Abdullahi has read about the judgment in the newspapers, he cannot act on reports in the media, as he was yet to get a copy of the judgment and peruse it.

“The judiciary cannot be stampeded, as it is used to following due diligence in its activities. So, litigants have to bear with us,” the source added.

The Ibadan Division of the appellate court, which ordered the re-trial, it was gathered, had been directed to quickly forward the list to Justice Abdulahi.

A major challenge for the court this time around was that the court has to look for judges, who could dispense justice to all the parties within a reasonable time, it was further learnt.
It would be recalled that the Court of Appeal that sat in Ibadan, Oyo State, which was led by Justice Victor Omage had set aside the verdict of the Justice Thomas Naron-led tribunal on the ground that the tribunal was partial in its decision.

It subsequently ordered that the Court of Appeal President should set up a fresh panel to try the matter again.

Since after the judgment, there had been calls for an urgent constitution of the new panel for the Osun governorship election petition.
